2020 Toyota Hawaii and UH Athletics Partnership Sweepstakes   - ULTIMATE Tailgate Kit

The 2020 Toyota Hawaii and UH Athletics Partnership Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Instagram. 

ELIGIBILITY: Open only to legal residents of Hawaii, 18 years of age or older. Void outside of the State of Hawaii and where prohibited.  By participating, entrants agree to be bound by these Official Rules and the decisions of the judges and/or Sponsor, which are binding and final on matters relating to this sweepstakes.  Sweepstakes is subject to all applicable federal, state and local laws. 

TO ENTER: Between 12:01 a.m. HST on Friday, October 9, 2020 and 11:59 p.m. HST on Friday, October 16, 2020 (the “Entry Period”), log-in to your Instagram account and follow Toyota Hawaii (“Entry”) @toyotahi (if you are not already doing so) and share @toyotahi’s post from 10/9/20 to your Instagram story, tagging @toyotahi in your story. Tag at least one (1) friend in the comments of @toyotahi’s 10/9/20 post. Within the entry period, entrant may post a photo/video relating to UH sports on their personal Instagram profile and tag @toyotahi on the post to receive one (1) additional entry. Maximum of two (2) entries per person. To be eligible for this sweepstakes, you must follow and share to your Instagram story as instructed above by 11:59 p.m. HST on October 16, 2020. By submitting an entry, you are agreeing to all the terms of these Official Rules. 

RANDOM DRAWING & ODDS OF WINNING:  One (1) potential grand prize winner will be selected in a random drawing held on or about Monday, October 19, 2020 from all eligible entries received throughout the Entry Period. Odds of winning depend on the number of eligible entries received throughout the Entry Period. 

PRIZES (1): One (1) prize winner will receive 2020 Toyota Hawaii and UH Athletics Partnership Ultimate Tailgate package. The prize package includes: one (1) YETI Tundra 65 Hard Cooler, one (1) Cornhole Set, two (2) Yeti Can Insulators - regular, two (2) Yeti Can Insulators – slim, four (4) Coleman Folding Chairs, one (1) Cuisinart Grilling Set, one (1) Canopy Tent, one (1) Weber Portable Grill, one (1) Sony Portable Bluetooth Speaker w/ Cupholders.  

Approximate Retail Value (“ARV”) of prize is $2,500.  

WINNER NOTIFICATION AND PRIZE ACCEPTANCE: The potential winner will be notified by Sponsor via Instagram direct message or comment on or about October 19, 2020 and instructed to provide their phone and/or e-mail address for further prize communication within 24 hours of being notified. Potential winner will be required to execute and return a publicity release within two (2) days of date of issuance. If such documents are not returned within the specified time period, prize notification is returned as undeliverable, Sponsor is unable to contact the potential winner or the potential winner is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor’s discretion, an alternate winner may be selected. Winner may waive their right to receive the prize. Prize is non-assignable and nontransferable. No substitutions allowed by winner. Prize is subject to availability and Sponsor reserves the right to substitute a prize of comparable or greater value. Winner is solely responsible for reporting and payment of any federal, state and local taxes on the prize and will be solely responsible for any additional costs and expenses not specified above as being provided, including but not limited to additional ground transportation, luggage fees (if applicable), meals, souvenirs and gratuities.   

GENERAL CONDITIONS: Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, or delayed entries; or for or technical failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the sweepstakes, the processing of entries, the announcement of the prize or in any sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by any equipment or programming associated with or utilized in the sweepstakes.  Released Parties are not responsible for injury or damage to participants resulting from participating in this sweepstakes.  Persons who tamper with or abuse any aspect of the sweepstakes or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void.  Should any portion of the sweepstakes be, in Sponsor’s sole opinion, compromised by non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the sweepstakes and, if terminated, at its discretion, select the potential winner from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Entrants, by participating, agree that Sponsor and Partners (University of Hawaii Athletics), Instagram, and their respective parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this sweepstakes.  Winner, by acceptance of prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.  

FOOTAGE: Winner and their guest may be photographed, videotaped and otherwise recorded by Sponsor while receiving their prize (collectively, "Footage"). Footage will be owned by Sponsor who has the right to use, edit, adapt, post, stream, copy and exploit such Footage and all elements embodied therein, including any names and likenesses embodied therein, on social media and in any and all media now known or hereafter devised throughout the world, in perpetuity, for advertising, promotional, trade and other purposes. By accepting the prize, winner agrees that his/her name and likeness and those of any other individuals present may be included in the Footage, in Sponsor’s sole discretion. Winner agrees to help Sponsor retain necessary releases (as applicable) if requested by Sponsor to do so.  

ARBITRATION: Except where prohibited by law, as a condition of participating in this Sweepstakes, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.  

CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of Hawaii, USA.  

WINNER’S NAME: For the name of the winner (available after October 19, 2020) send a self-addressed stamped envelope to: Toyota Hawaii Marketing/UH Athletics Sweepstakes, 2850A Pukoloa Street, Honolulu, HI 96819 for receipt no later than November 1, 2020.
